This Consent and User Declaration Agreement (“Agreement”) is a legally binding addition to the Blue Track Terms of Service. By activating any device on the Blue Track platform, you explicitly declare, warrant, and agree to the terms below.
- Verification of Legal Authority to Track
By adding any mobile device, vehicle, or asset to the Blue Track Traccar server, you explicitly declare that:
- You are the legal owner of the device being tracked; or
- You are the legal parent or court-appointed guardian of the minor child (under 18) using the device; or
- You have obtained explicit, clear, and documented written consent from the individual carrying or using the tracked device.
- Strict Prohibition of Unlawful Surveillance (Stalking)
- Zero Tolerance: You are strictly prohibited from using Blue Track to track any adult individual without their knowledge and ongoing consent.
- Illegal Use: Utilizing this software for covert tracking, stalking, domestic harassment, or unauthorized surveillance is a criminal offense under South African law, including the Protection of Personal Information Act (POPIA) and the Protection from Harassment Act.
- Account Termination: If Blue Track receives a verified complaint or suspects unauthorized tracking, your account will be permanently terminated immediately without notice or refund.
- Workplace and Employee Tracking (Business Scale Plan)
If you are utilising the Business Scale Plan to track employees, contractors, or fleet drivers, you explicitly warrant that:
- A formal, written tracking policy has been signed by every tracked employee.
- Tracking is strictly limited to operational requirements and standard working hours, in compliance with South African labor and privacy laws.
- You accept all legal and financial liability regarding labor disputes or privacy claims brought by your staff.
- Explicit Consent for Location Processing
- Data Processing: You grant Blue Track explicit permission to capture, process, transmit, and display the real-time GPS coordinates of your connected devices.
- Revocation of Consent: Any individual being tracked reserves the right under POPIA to revoke their consent at any time. If an individual revokes consent, you agree to immediately delete their device from your Blue Track dashboard.
- Legal Indemnity and Liability Waiver
You agree to indemnify, defend, and hold harmless Blue Track, its owner, and freelance agents from and against any and all claims, damages, legal costs, criminal charges, or lawsuits arising from your failure to obtain the necessary legal consents before activating a device on our network.
